These Website Terms of Use (“Terms”) govern your access to and use of the public websites operated by Golden State Prognostics, LLC (“Company,” “we,” or “us”), including goldenstateprognostics.com (the “Site”). By accessing or using the Site, you agree to these Terms. Access to and use of the PrognostiXon platform itself is governed by a separate Master Services Agreement and applicable Order Form, not by these Terms.

1. Use of the Site

You may use the Site for lawful, informational purposes only. You agree not to (a) use the Site in violation of any applicable law; (b) attempt to gain unauthorized access to the Site or its systems; (c) interfere with or disrupt the Site; (d) use automated means to scrape, harvest, or collect content except as permitted by our published robots file; or (e) misrepresent your identity or affiliation.

2. Intellectual Property

The Site and its content, including text, graphics, logos, and the PrognostiXon™ trademark, are owned by or licensed to Company and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to view the Site for your own informational use. You may not copy, reproduce, republish, or commercially exploit Site content without our prior written consent.

3. No Professional Advice; Informational Only

Content on the Site is provided for general informational purposes and does not constitute legal, financial, investment, lobbying, policy, or other professional advice, and is not a prediction of any outcome. You should not act on Site content without seeking independent professional advice.

4. Third-Party Links

The Site may link to third-party websites or resources. We do not control and are not responsible for third-party content, and links do not imply endorsement.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE.

8. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in California, except that Company may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property. (Disputes relating to the PrognostiXon platform are governed by the dispute-resolution provisions of the applicable Master Services Agreement.)

9. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a revised effective date, and your continued use of the Site constitutes acceptance of the updated Terms.
